KellyGram – Don’t Let the Bedbugs Bite!

 

School is back in session, and the dog days of summer are nearing an end. Nonetheless, South Carolina’s beautiful beaches and its college football will continue to draw tourists, from both in and out of state, for months to come. In this week’s KellyGram, I want to shed some light on a growing risk that travelers face but often do not see—bedbugs.

Bedbug attacks are on the rise in the United States, a fact largely attributed to the growing rates of international and domestic travel by its residents as airfare becomes increasingly affordable. Bedbug professionals rank hotels and motels as the third most common place to encounter bedbugs, and against popular belief, bedbug infestations are not a problem exclusive to cheap, roadside motels. The CDC reports that, just like everybody else, bedbugs also enjoy the occasional stay at five-star hotels and resorts. Thus, it is important for all travelers to brush up on how to avoid bedbugs. For starters, the EPA has issued a list of preventative measures, found here, and www.bedbugregistry.com offers a public database of user-submitted bedbug reports in the US and Canada.

Unfortunately, although adult bedbugs are visible, they often remain hidden and only make themselves known when they bite their unsuspecting victims. These bites can be extremely painful, especially to those with bedbug allergies, and often last for thirty days or more. The bite symptoms vary from person to person, but generally appear as small, unsightly red bumps or welts. Bedbug attacks are also very emotionally traumatic, as they occur when one is most vulnerable and disrupt the sanctuary of the bedroom and sleep. The pests will even hide in travelers’ luggage and infiltrate their homes, leaving them with the extremely difficult feat of bedbug eradication.

 

Those who have the misfortune of suffering a bedbug attack in a hotel, resort, etc. may, at the very least, have a legal remedy available. A bedbug victim may be entitled to compensation for any medical bills, lost wages, and pain and suffering for bite injuries, and for furniture replacement and extermination costs should the bugs follow that person home. KellyGram – Central Carolina Community Foundation

 

I am a firm believer in the adage “to whom much has been given, much is expected,” and I have lived by this principal during my long and successful legal career. With no shortage of blessings in my lifetime, I have a moral duty to repay what I’ve been given by serving others.

One way in which I have been able to serve is through Central Carolina Community Foundation, an organization that shares my sentiment on the importance of giving back. The Community Foundation is a non-profit that helps charitable people and businesses make impactful giving decisions that best serve the needs of our community. The organization’s operations extend across eleven counties in the Midlands, including Richland, Lexington, and Fairfield Counties, where the majority of my legal practice takes place. I have had the privilege of sitting on the Central Carolina Community Foundation Board for a total of six years, serving as Board Chair for two of those years. And, while my years of working with the Community Foundation brought with them a tremendous sense of accomplishment, my greatest success during my tenure there was the appointment of JoAnn Turnquist as President and CEO of the organization—through her extraordinary leadership, the Community Foundation has reached new, extraordinary levels and has become more impactful than ever before.

 

Central Carolina Community Foundation’s mission is to promote, facilitate, and increase philanthropy to create a sustainable impact within our community through responsible giving. They do this in the following ways:

  • Promote & Increase Philanthropy: Initiatives like Midlands Gives, the annual online day of giving, allows everyone in our community to be a philanthropist. Over the last five years, Midlands Gives has raised over $7.25 million for hundreds of local nonprofits.

  • Connect Our Community: The Foundation connects people in our community together to deploy resources effectively and impact our community. On October 24, 2018, the first On the Table initiative will bring small groups together across Richland and Lexington counties to discuss how to make our community stronger.

  • Distribute Grants: Since inception in 1984, the Foundation has distributed over $157 million in grants. The Foundation’s Connected Communities grants fund innovative projects that strengthen our region by creating vibrant social offerings, superb public spaces, and a welcoming community.

  • Provide Fiscal Oversight: The Foundation manages charitable funds established by families, businesses, and nonprofits and works with these donors to fulfill their charitable wishes. As partners in giving, Foundation donors receive the tax advantages of a public charity combined with the personal recognition, involvement, and flexibility of a private foundation.

KellyGram – Hurt on the Job?

 

For 40+ years, I have had the privilege of representing people all over the state who have suffered on-the-job injuries. Handling workers’ compensation claims is a highly rewarding practice, and I am proud to have an exceptional team in place to help hard-working South Carolinians get back on track after their lives have been disrupted by a work-related injury.

Injuries occur in every profession and affect workers from all walks of life. Our clients’ professions range broadly, from construction to health care to higher education, and the like. Likewise, the types of claims covered under South Carolina’s workers’ compensation laws run the gambit from A to Z. For example, workers may bring a claim for an acute injury, such as a broken bone or laceration, or for more complex problems that develop over time as a result of the normal working conditions of a particular job. For instance, carpal tunnel syndrome may be a compensable injury for workers who perform tasks requiring repetitive wrist or hand motions, like typing; or, someone whose work requires prolonged exposure to mold or toxins may have a claim it later causes respiratory problems.

Rarely do people expect to get hurt while at work, yet it happens all the time. South Carolina has workers’ compensation laws in place for that very reason. Generally speaking, an employee who has suffered an on-the-job injury is entitled to reimbursement for related medical expenses, weekly payment while he or she is unable to work, and compensation for any permanent disability. So although these injuries may be traumatic, they should never lead to financial ruin. Unfortunately, though, the workers’ compensation process is complex, and injured workers are regularly denied their rightful benefits.

Over the past several years, workers’ compensation law has become a fiercely competitive market, but so far this area of my practice has continued to thrive. We may not have billboards around town or flashy, primetime commercials, but we do have decades of experience fighting for injured workers and a genuine desire to help people. My team knows the ins and outs of this field of law, and when I tell folks I wrote the book on workers’ comp, it’s not hyperbole!

KellyGram – V.C. Summer Nuclear Meltdown: One Year Later

 

Lately, it seems like SCANA is receiving a lot of publicity—but not the good kind. And, while I hate to pile onto the outcry, a year has passed since the V.C. Summer nuclear project was abandoned, and I, along with thousands of others, continue to lament the devastating damage caused by this nuclear disaster of sorts.

The V.C. Summer shutdown was particularly devastating for the residents of Fairfield County, whom I have grown particularly fond of during my time practicing law there. The loss of 6,000 jobs, as well as decades of future income from a stable industry, has brought this county economically to its knees. Though Fairfield is the ninth smallest county in South Carolina, it has the highest unemployment rates in the state, and the level of poverty there is alarming. With the loss of V.C. Summer, hope for many residents there looks as bleak as the unoccupied storefronts that line the streets of downtown Winnsboro. Nonetheless, as described in this compelling interview with Senator Mike Fanning, the strong citizens of Fairfield County love their home, and they have come together in this time of crisis with shared determination to rebuild and improve the quality of life in their community.

KellyGram – Respect (and Protect) Your Elders

The legal team at Mike Kelly Law Group receives calls all too frequently from concerned family members whose loved ones have faced mistreatment in a nursing home or assisted living facility. Cases of nursing home negligence and abuse are extremely disconcerting. Not only does the frequency of mistreatment cause me grave concern for the vulnerable residents of these facilities, it leaves me worried about my own future as well. After all, I’m no spring chicken, and I may well find myself in assisted living one day sooner rather than later!

Callers and clients shed a bright light on how severe a problem elder abuse can be within the walls of the very facilities promising a better life and standard of care to our older population. Complaints range from bed sores, to physical mishandling of patients, to avoidable fatalities. The word neglect carries a strong connotation, but sadly it is prevalent in the nursing home industry. A startling 40% of nursing home residents have reported abuse, and over 90% have either experienced neglect or witnessed the neglect of a fellow resident. Studies show that approximately half of nursing home attendants have abused or neglected patients.

At the Mike Kelly Law Group, we carefully screen incoming complaints of nursing home negligence and vigorously pursue those claims which are actionable. We undertake representation for two very important reasons: 1) to compensate victims for their injury or loss; and 2) to prevent future harm by holding the offending facilities accountable for their misconduct.

KellyGram – People Helping People

 

For some time now, the media has been dominated by a seemingly endless stream of alarming, tragic, and divisive news, leaving many of us desperate for an uplifting story. Like a breath of fresh air, recent headlines highlighting the courage, selflessness, and resolve of everyday people have broken the monotony of doom and gloom and restored some faith in humanity. Last week, the world watched as a team of divers risked their lives in the successful mission to rescue 12 boys and their soccer coach, who were trapped deep inside a cave that flooded during a team excursion. Then, on Monday, this heartwarming story went viral after a young man walked all night to his new job, 20 miles away; his employer’s reaction will literally bring tears to your eyes.

These modern heroes remind us that, amidst the hate and corruption plaguing today’s society, there are powerful forces of good at work. I believe that we would all be well served physically, emotionally, and spiritually by making a habit of going the extra mile to serve others. What I love most about being an attorney is that I am in a prime position to help people and make a positive difference in their lives. Just this week, one of our lawyers shared with me an anecdote about the impact a personal injury settlement had on a teenage client. The young man, as one of four children in a single-parent household, has neither been afforded luxuries in the past, nor has he pressed for them. Still, his mom knew that he had dreamed of getting a pair of Air Jordan shoes for years. After we settled his case, the boy’s mother surprised him with a trip to Foot Locker. As mom described her son’s reaction to learning he was getting a pair of Air Jordans—sheer disbelief followed by wide-eyed excitement and overwhelming joy—both she and my associate became teary-eyed.

In my years of practice, countless clients have shared similarly touching experiences. Though they may not make for front-page news, these accounts share the sentiment of recent headlines and demonstrate that an ordinary person can profoundly and positively impact the lives of others. So, when the status quo is grim, take comfort in knowing that you wield the power to make the world a better place by simply making a conscious effort to do good!

KellyGram – Vacation Safety

 

We are in the midst of the summer vacation season, and even I’ve been able to spend a little time at the beach myself this year! Over 14 million people visit Myrtle Beach every year, and having an office in the Grand Strand has helped me to appreciate the fact that, often times, the human tendency is to let one’s guard down while on vacation as far as personal safety is concerned. For one thing, people attempt to engage in activities that they wouldn’t dream of doing at home, particularly amusement activities like surfing, jet skiing, or parasailing. Moreover, driving in heavy traffic in an unfamiliar area can lead to an increase in motor vehicle accidents.

My Myrtle Beach practice has helped to assist innumerable fine individuals whose vacations, and sometimes lives, have been ruined by an injury at the hands of a negligent driver, ride operator, or hotel staff. And, although these individuals have been hurt by no fault of their own, most of them share the sentiment that they just did not think anything bad would happen while on vacation. Unfortunately, while a holiday does provide an escape from the day-to-day, it is not a shield from human error or vulnerability.

So here’s the takeaway from this week’s KellyGram: when you go on vacation, have a great time, but be just as alert and aware of your surroundings and personal safety as you would be at home, if not more so!

KellyGram – Welcome, Karlen!

 

The Mike Kelly Law Group is proud to announce in this week’s KellyGram that attorney Karlen Senn is joining our litigation team! As our practice has flourished and grown, so has our need for accomplished lawyers, and Karlen is going to be a great fit for the team.

Born and raised in the Columbia area, Karlen is a South Carolina native. After she graduated from Hammond School, Karlen attended Converse College where she earned dual degrees in history and politics. She went on to receive her JD from the University of South Carolina School of Law in 2014, and began her legal career as a judicial law clerk to the Honorable Robert E. Hood of the South Carolina Circuit Court.

Prior to joining the Mike Kelly Law Group, Karlen served as an Assistant Solicitor in the Fifth Judicial Circuit. An experienced trial attorney, Karlen represented the State of South Carolina in many jury trials, both in Circuit and Magistrate Courts of Richland County.

Karlen devotes nearly all of her spare time to her daughter, sharing with her a love of the beach and the outdoors.

KellyGram – America the Beautiful

 

Believe it or not, on Wednesday our nation will be celebrating its 242nd Independence Day! Now, more than ever, I am grateful to be an American, living in a country where freedom is still a reality. Not a day goes by that we are not reminded of the war, oppression, and deprivation of human rights that devastate so many lives and nations. Still, many Americans take for granted their individual liberties, forgetting that they come at a tremendous cost. Thousands of soldiers sacrificed themselves in pursuit of our nation’s independence, and ever since, our service members have continued for 242 years to dedicate their lives to protect the freedom on which America was founded. Although I have never served in the military, I have the utmost respect and gratitude for those men and women who have fought, and continue to fight, to preserve our rights and the values of this country.

That’s not to say America does not have its fair share of challenges, and I, like many others, don’t always agree with the approach taken by its leaders. But the beauty of America is that its people hold the power to challenge and change the status quo, and to redirect the country’s trajectory when it veers off course. This is why, even when America is not the greatest version of itself, it is still the greatest nation on earth.

KellyGram – The Brookland Foundation

 

The Brookland Foundation is one of the many ministries of Brookland Baptist Church, headquartered in West Columbia. Established in 1994, the Brookland Foundation is a non-profit, community-based organization whose mission is “to improve the lives of people by developing and promoting efforts to enhance their spiritual, emotional, physical, social, and economic well-being.” To accomplish this mission, the foundation has set up five primary programs:

(1) The Health and Wellness Program is an initiative to educate the community with information that encourages the pursuit of optimal health.

(2) The HIV/AIDS Program raises community awareness about the HIV virus, and encourages risk education and preventative practices.

(3) The Tutorial Program provides after-school and evening tutoring and homework assistance for K-12 students.

(4) The Homeless Outreach Program promotes awareness and serves as an advocate for the spiritual, psychological, and physiological needs of homeless individuals and families.

(5) The Male Initiative Program focuses on strategies and solutions designed to empower men and their families.

The Brookland Foundation is the brainchild of Brookland Baptist Church’s founding pastor, and a personal friend of mine, Rev. Dr. Charles B. Jackson, Sr. Last week, the Mike Kelly Law Group had the pleasure and privilege of supporting the Foundation by participating in its 22nd Annual Charity Golf Tournament held at the Members Club at Woodcreek. The firm will continue to support the Ministry of Charles P. Jackson, Sr. and the Brookland Foundation, as well as the other outstanding programs at Brookland Baptist Church.
